Employee vs independent contractor

This distinction matters for tax and UIF. If a gardener works set hours at your direction and you provide tools, they are likely an employee. You must register for UIF and provide payslips. If the gardener sets their own schedule, uses their own tools, and invoices you, they are an independent contractor. SARS looks at the substance of the relationship, not what you call it.

  • Employee: fixed hours, you provide tools, UIF and payslip required
  • Contractor: sets own schedule, own tools, invoices you for services
  • If unsure, SARS applies the 'dominant impression' test

How much should a gardener charge in South Africa?

Should a gardener invoice or just get paid cash?

Always invoice. It protects both you and the client. Invoices provide proof of income (useful for bank loans), help with tax records, and look professional. Clients with rental properties need invoices for expense claims.

Does a gardener need to register for UIF?

If you employ a gardener (even part-time, 24+ hours per month), you must register for UIF under the Unemployment Insurance Act 63 of 2001. However, if the gardener is an independent contractor invoicing you, they handle their own tax.
