Consumer Protection Act and gym memberships

The Consumer Protection Act 68 of 2008 has specific provisions that apply to gym memberships in South Africa. As a gym owner, you should know:

  • Section 14: Fixed-term agreements. Gym memberships are fixed-term agreements. Members have the right to cancel with 20 business days' written notice, even before the contract period ends. You may charge a reasonable cancellation penalty, but you cannot refuse cancellation.
  • Section 14(2)(b): Automatic renewal. If a membership auto-renews, you must notify the member 40–80 business days before the renewal date and give them the option to cancel.
  • Section 17(1): Cooling-off period. Members who sign up through direct marketing (e.g., a promotion at a shopping centre) have 5 business days to cancel without penalty.
  • Section 22: Receipts. You must provide a receipt or proof of payment for every transaction when the member requests it. wabill's automated receipts handle this.

Can members cancel easily?

Yes. Under the Consumer Protection Act 68 of 2008, Section 14, members in fixed-term agreements have the right to cancel with 20 business days' written notice. You can remove a member from a billing group immediately on your wabill dashboard. They won't receive further invoices. This keeps you compliant with the CPA.

Can I set up different membership levels?

Yes. Create a separate group for each membership tier, for example, 'Off-Peak R450/month', 'Standard R650/month', and 'Premium R850/month'. Each group bills independently with its own amount and schedule.

How do members pay?
