BCEA Section 33: payslip delivery

The Basic Conditions of Employment Act requires employers to provide written payment particulars on each payday. The Electronic Communications and Transactions Act (ECTA), Section 12, confirms that electronic documents satisfy the “in writing” requirement. The Labour Court upheld this in Sihlali v SABC.

POPIA Section 19: security safeguards

POPIA requires “appropriate, reasonable technical and organisational measures” to protect personal information. Password-protected PDFs combined with WhatsApp's end-to-end encryption satisfy this standard. Payslip delivery itself falls under “compliance with a legal obligation” (BCEA), so separate employee consent for the act of delivery is not required.

Is it legal to send payslips via WhatsApp in South Africa?

Yes. The Electronic Communications and Transactions Act (ECTA), Section 12, provides that a document required to be 'in writing' is satisfied by a data message accessible for subsequent reference. The Labour Court confirmed this principle in Sihlali v SA Broadcasting Corporation Ltd. A password-protected PDF payslip delivered via WhatsApp meets the BCEA Section 33 requirement for written payment particulars.

Which payroll systems does wabill work with?

How are payslips protected?

Every payslip PDF is password-protected before delivery. The password is typically the employee's ID number or a value you choose. WhatsApp itself uses end-to-end encryption, meaning no third party (including WhatsApp) can read the content in transit. This combination satisfies the 'appropriate, reasonable technical measures' standard under POPIA Section 19.

What if an employee doesn't have a smartphone?

WhatsApp runs on entry-level smartphones available from under R1,000 in South Africa. Following the 2025 removal of the 9% excise duty on devices under R2,500, first-time smartphone buyers increased by 16% (Connecting Africa, 2025). For the small number of employees without smartphones, you can generate PDFs through wabill and distribute them through an alternative channel.
